N20 Timing Chain Settlement

A nationwide settlement has been reached in a class action lawsuit against BMW of North America, LLC, entitled Gelis, et al. v. Bayerische Motoren Werke Aktiengesellschaft and BMW of North America, LLC, Civil Action No. 2:17-cv-07386, involving the timing chain and oil pump drive chain modules in certain model-year 2012 to 2015 BMW vehicles.

Settlement Terms

You may be entitled to reimbursement for some or all of your past out-of-pocket expenses incurred for repairing or replacing one failed timing chain module, oil pump drive chain module, and engine (if damaged due to a failure of the timing chain or oil pump drive chain modules).

Timing Chain Service

The timing belt is vital to the performance and safety of your BMW, typically your timing belt will need to be replaced between 40,000 and 100,000 miles depending on your driving habits and lifestyle demands. When it comes time to replace your timing belt, you should receive an engine warning notification on your dashboard before rattling occurs to inform you that it’s time to bring your BMW in for a check-up.

The timing chain stretches due to internal component wear over time. Poor maintenance, time, and other factors can cause your timing chain to wear.

The longevity of your BMW’s timing chain can vary between 40,000 to 100,000 miles. Most newer models should last between 80,000 to 100,000 miles.

A timing chain synchronizes the rotation of the crankshaft and camshaft(s) ensuring the proper timing and allows the engine’s valves to open and close during each cylinder’s firing.

If your chain breaks, your BMW will not operate.

Yes, we recommend that all components of the timing system be replaced simultaneously.

Signs your BMW’s timing chain needs to be replaced include engine codes and check engine alerts, engine rattle, the engine won’t start, chain pin and plate wear, and more.

After the Settlement becomes effective, you may be entitled to reimbursement for some or all of your past out-of-pocket expenses incurred for repairing or replacing one failed timing chain module, oil pump drive chain module, and engine (if damaged due to a failure of the timing chain or oil pump drive chain modules).

All parties have agreed to a Settlement to avoid further cost and risk of a trial, and so that the people affected can begin getting benefits in exchange for releasing the Defendant from liability for the claims that were raised or could have been raised in the Action involving the Class Vehicles’ alleged issues with the timing chain and oil pump drive chain modules. The Settlement does not mean that BMW of North America broke any laws, or otherwise did anything wrong, because Judge Waldor did not decide which side was right. The Class Representatives and the lawyers representing them think the Settlement is fair and reasonable for the Class.
